Terms and Conditions

F. Lessee’s Obligations

By renting a vehicle from SOSA Rental, the Lessee agrees:

• Not to use the vehicle for illegal activities, for hire, or in dangerous conditions.
• Not to overload the vehicle or modify it in any way.
• Not to permit unauthorized drivers to operate the vehicle.
• To ensure the vehicle is used responsibly and in compliance with Maltese laws.

G. Authorized Drivers

Only the Lessee and the authorized drivers listed in the rental agreement may operate the vehicle. The Lessee must provide the necessary documentation to validate the driver’s license and identification.

H. Vehicle Usage and Restrictions

• Permitted Use
  • The vehicle is to be used solely within the Maltese Islands unless prior written consent is obtained from the Lessor.

• Prohibited Uses
  • The vehicle may not be used for racing, off-roading, or any illegal activity. Unauthorized use will result in termination of the agreement and possible financial penalties.

I. Insurance and Liability

• Insurance
  • SOSA Rental provides comprehensive insurance for the vehicle under Maltese law. However, the Lessee is responsible for any damages not covered by insurance, including damages caused by negligence or unauthorized use.

• Lessee’s Liability
  • In the event of any accidents, theft, or damages, the Lessee is liable for any costs not covered by insurance, and must indemnify SOSA Rental against third-party claims.

J. Fuel Policy

• The vehicle will be supplied with a full tank of fuel at the start of the rental period.
• The vehicle must be returned with a full tank. If the vehicle is returned with less fuel, a refuelling charge of €10 plus the cost of the missing fuel will apply.

K. Damages and Security Deposit

• Security Deposit
  • A refundable deposit is required to cover potential damages or late return. The amount will be specified at the time of booking.

• Damages
  •  Any damage to the vehicle during the rental period, whether accidental or due to misuse, will be deducted from the security deposit. If damages exceed the deposit amount, the Lessee agrees to pay the difference.

L. Breakdowns and Accidents

• Breakdowns
  • In case of a vehicle breakdown, contact SOSA Rental immediately for assistance. Repairs should not be made without prior approval.

• Accidents
  • In the event of an accident, theft, or vandalism, the Lessee must report the incident to the relevant authorities and SOSA Rental immediately.

M. Termination of Agreement

The rental agreement will terminate:

• Upon the return of the vehicle in good condition and the settlement of all outstanding charges.
• If the Lessee breaches any terms or engages in illegal or dangerous activity.
• In case of early termination, no refunds will be issued for unused rental days.

N. Governing Law and Dispute Resolution

This terms and conditions shall be governed by the laws of Malta. In the event of a dispute, both parties agree to seek resolution through arbitration in Malta.

O. Force Majeure

Neither party shall be liable for any failure to perform their obligations under this Agreement due to unforeseen circumstances beyond their control, including but not limited to natural disasters, government actions, or industrial disputes.

P. Changes to Terms and Conditions

SOSA Rental reserves the right to update or amend these Terms and Conditions at any time. All changes will be posted on the website and will take effect immediately upon publication.

Q. Entire Agreement

These Terms and Conditions, along with the rental agreement, constitute the entire understanding between SOSA Rental and the Lessee. Any changes to these terms must be made in writing and signed by both parties.

By booking a rental vehicle with SOSA Rental, you acknowledge that you have read, understood, and agree to these Terms and Conditions. These Terms and Conditions are subject to change without notice. Please review them regularly for updates.
